HINTS

For private use only software from EDP Service Marchert is FREEWARE therefore the usage is for free. The software is SHAREWARE and not for free if you use it for (part-time) profession purposes. If you want to use the program after the testing phase has expired, you have to purchase a license. In line with this license contract the program can be shared for free and unmodified.

Please read the following terms of this contract carefully before you install and use the software. By using or installation of a software copy you affirm the agreement with the terms of the present license contract.

If you do not agree with all terms of this license contract you may not install and/or use this software.

RANGE OF USE

The offered software must not be used in the following areas:

• Production, distribution and usage of firearms
• Federal Armed Forces and armaments industry
• Sex- and porn industry
• Factory farming
• Genetic engineering
• Production and distribution of tobacco and alcohol

Employees who work in one or some of the mentioned areas are allowed to use the software for private, non commercial  purposes, as long as no destructive goals are pursued.

SECURITY ADVICE

The present software has not been developed for systems that serve directly or indirectly for life sustainment. Therefor it does not guarantee absolute system stability or lack of failure. If the software is used in an environment where a system failure can lead to physical and/or substantial damage and/or a loss of image, solely the user takes the responsibility for the usage. In addition no guarantee can be provided for damages that emerge from destructive programs that also lead to physical and/or substantial damages and/or a loss of image.

LICENSE AREA

For private use only:

You can install and use this software with its restrictions of the private license on all computers which you use as main user. If you will use this software some day for your job (too), you have to buy a license (there is no need to reinstallt the software).

For profession use without license:

The available program version is exclusively intended for testing. The testing time area amounts to max. 30 days and may not be extended not by new installation, installation in virtual systems, other computers or by other time and/or date manipulations, in particular not by auxiliary software. They may pass the program on free of charge and invariably to other users for testing. If you would like to work at expiration of the 30 days further with the program, you must acquire a license (there is no need to reinstallt the software).

For profession use with license:

Important: all licenses are related to users not to computers.

That means that the programs are licensed according to the amount of the users that work with the program, independent from the amount of computers the program is installed at.

If you purchased e.g. a single license, you are allowed to install the program on all computers you use as long as you are the main user of these computers. Persons that use one of your computers with the installed program only from time to time (that means not regularly) do not need a license.

But if 2 or more user work with one computer (e.g. shift work, spouse or in another way regular) every user that works with the program (even if it is not regularly) needs to acquire a license.

Licenses are always related to one location (=city) with any sites inside the location. The maximum amount of users can be seen in the invoice. One exception from this rule is the one-user-license. This license can be used by the corresponding license holder in several locations.

The licenses can be used from the license holders both private and commercial. But a license can not be shared. That means that it is not allowed that e.g. one employee works with a license in the company and another employee works with the same license only private. 

UPDATES/UPGRADES

All updates and upgrades are unlimited for free. If you purchased program packages you get special conditions for new tools.

COPYRIGHT

All rights of the software (idea, functioning, layout and so on) remain with the producer. With the installation of the software the user gets solely usage rights, no property right. The software is subject to legal regulations for protection of intellectual property rights and therefore must be treated in that way. It is prohibited to attempt to modify or decompile the software. Moreover you are not allowed to license, lease, distribute or sell the software to other persons.

WARRANTY

There is a warranty for the functions described in the delivered help file. It is guaranteed that the unmodified original software (available under http://www.outlook-stuff.com) is free from spyware, malware, trojans and other malicious programs and also free of viruses that are known at the moment of delivery.

LIABILITY

This software has been diligently produced. However, regarding the multitude of used computer systems with all the different hard- and software constellations, no liability can be provided. Especially a liability for a loss of profit and other financial losses is expressly excluded. The exclusion of liability is not effective for intention or gross negligence. In the case of gross negligence the burden of proof is at the user. Claims according to the product liability act are unaffected.

SEVERABILITY CLAUSE

If single terms of this license are completely or partially ineffective, the validity of the other terms is unaffected.

The present license agreement applies exclusively to german legislation to the exclusion of Convention on the International Sale of Goods (CISG).

This hint remains about 20 seconds to get regognized and read. After that the hint only appears for 10 seconds.

The hint is one of some more restrictions of the free private license. All restrictions you can repeal by buing a licnese key (there is no need to reinstall the programs).
